We're thrilled to invite you to take part in our contest. All you need to do is share your project idea with us via email at social@neumann.com, using the subject line "Spend Time with Fritz". If you're selected as the winner, we'll provide you with a KU 100 for three weeks to use in your project.

The contest is live until December 31st, 2023, and every month, our esteemed jury comprised of Neumann's Portfolio, Content Marketing, and Social Media Manager will select one lucky winner.

“SPEND TIME WITH FRITZ” LOTTERY ON NEUMANN’S INSTAGRAM AND FACEBOOK ACCOUNTS 

CONDITIONS OF ENTRY, AND DATA PROTECTION BRIEFING 

From 14-07-2023 until 31-12-2023, you can enter the “Spend time with Fritz” lottery under the conditions set out below.       

A. PARTICIPATION CONDITIONS  

 1. ORGANISER

The lottery is organised by Georg Neumann GmbH, Leipziger Straße 112, 10117 Berlin (Veranstalter (=Organiser)).  The lottery has no connection with Meta and is not in any way sponsored, supported or organised by Meta.  

2. QUALIFYING PARTICIPANTS

All persons of adult age who are domiciled in Germany, Austria, Switzerland, France, Sweden, Norway, Finland, Denmark, Belgium, Luxembourg, the Netherlands, the UK, Ireland, Canada, the USA, Australia or New Zealand are entitled to participate. Employees (and their family members) of the Organiser or of companies receiving orders from the Organiser are excluded from participation. Each individual person may participate once only.  

Participation is possible once only per project (music production, ASMR, theatre production, industrial applications etc.). Multiple participation with various projects within the lottery period is permissible.  

The Organiser reserves the right to exclude from the lottery any participants who infringe the participation conditions or good moral standards and/or who make any unfair and/or improper attempt to influence the draw.  

 3. EXPIRY

Within the lottery period as defined in Paragraph 4, participants must apply to the Organiser, by sending an email to social@neumann.com, for the loan of a KU 100 robot head (“KU 100“ or “Fritz“). The application must include a description of the extent to which the KU 100 will be incorporated into the participant’s respective project.

The subject heading must be given as “Spend Time with Fritz”. No lottery entries with a different subject heading can be accepted.

Each month, a winner corresponding to Paragraph 5 is designated from the range of valid applications. The winner will be loaned a Fritz for a period of 21 days for purposes of implementing the project described in the participant’s application.

SENNHEISER

The winner is required to send content in the following form to the Organiser, by means of an email to social@neumann.com:

• Minimum of 5 photos (at least 2000 pixels × 3000 pixels) of the project using the KU 100 whilst the project is in progress,
• Plus 1 video (optional) illustrating the project process
• In all cases: the project results in any desired form (photos, videos, audio etc.)

Furthermore, participants grant the Organiser rights of utilisation, without any chronological or geographical limitations, for all social media channels (Facebook, Instagram, LinkedIn, Youtube), websites and newsletters; and for internal correspondence channels within the Sennheiser group.

By 21 days, at latest, following receipt of the Fritz, it must be sent back in its original packaging to the Organiser, insured and with proof of posting. The date of dispatch is definitive. If this deadline is not fulfilled, then the participant will be charged €9,499.00 (including 19% VAT) or the corresponding figure in the respective national currency, for the Fritz.

The Fritz must be treated with care whilst on loan to the winner. The winner will be answerable to the Organiser for any instances of damage.

 4. PERIOD AND LOCATION FOR PARTICIPATION

The lottery will run on Facebook and on Instagram from 10 AM MET (=Middle European Time) on 14-07-2023 until 23:59 MET on 31-12-2023.

5. PROCEDURE FOR IDENTIFYING WINNERS

All entries received are reviewed on a monthly basis and assessed by a jury consisting of Neumann’s  portfolio manager, content manager und social media manager.

Each month, one (1) winner is chosen by the jury from the entire pool of participants. The date of receipt of the application is not significant, provided that it is within the lottery period. The winner declares his/her consent to be contacted by email in the event of a win.

6. WINNINGS

Each month, a winner will receive the loan of a “Fritz” KU 100 robot head for 21 days to support the winner’s project.

 7. NO PURCHASE REQUIRED

No purchase from (or payment to) the Organiser is required in order to participate in the lottery. The odds of winning are not in any way influenced by a purchase or by a payment. The odds of winning are governed by the number of participants in the lottery relative to the number of prizes to be won.

8. DATA PROTECTION

In the course of operating the lottery, personal data will be processed as described in the data protection briefing given below (see under B.).

 9. ACKNOWLEDGEMENT OF CONDITIONS FOR PARTICIPATION

By the fact of participating in the lottery, the participant is deemed to accept the conditions for participation.

10. LIABILITY

The Organiser is liable for any wilful intent and gross negligence which it may incur. It will be liable for moderate negligence only if it infringes a substantial contractual obligation (cardinal obligation) which is crucial to the normal operation of the agreement -- an obligation whose fulfilment the participant should normally be able to expect -- together with claims arising from loss of life, physical injury or damage to health.

11. EARLY TERMINATION OR INTERRUPTION

The Organiser reserves the right to interrupt the lottery or to terminate it early subject to an important reason for doing so.  In this context, particular examples of important reasons would include mandatory legal grounds together with Governmental orders, changes in legislation or other reasons precluding the holding of the lottery.

12. APPLICABLE LAW, JURISDICTION; SALVATION CLAUSE

Any disputes arising from or in connection with the above-described lottery will be governed by German law, excluding the law governing conflicts between legal systems, and excluding UN purchasing law (United Nations treaty on Contracts for International Sale of Goods). Hanover is the exclusive place of jurisdiction for all disputes arising from or in connection with these Conditions for Participation. Should any one of the clauses of this Agreement be or become invalid, then this will not affect the Agreement in other respects.

 B. DATA PROTECTION BRIEFING

The following items of personal data may be processed by Georg Neumann  GmbH, Leipziger Straße 112, 10117 Berlin, in the context of operating the lottery:

• Key details (e.g. forename, surname)
• Address details (e.g. street, postcode)  
• Contact details (e.g. telephone number, email address)
• Individual details relating to the respective lottery, especially the Instagram username.

Data is processed on the basis of implementing and fulfilling the contractual objectives relating to the lottery (refer Article 6, paragraph 1, clause b), GDPR). Only if the winner’s prior and express consent as defined in Article 6, paragraph 1, clause a), GDPR has been secured will any of the winner’s personal data be displayed on the Instagram profile of Georg Neumann GmbH.  

The participant’s logged data will be used by the organiser exclusively for the operation of the lottery, and particularly for purposes of identifying and notifying the winner and for the sending out of prizes.

Personal data will not be used for any purposes further to those described here, and there will be no forwarding of personal data to third parties. In particular, no data will be used for any other marketing purposes.

The participant’s logged personal data will be deleted as soon as the purpose for which it was necessary to process the data has been achieved. Different retention periods may apply under statutory legal rules.

In the participants’ capacity as data subjects, they hold the following further rights in relation to Georg Neumann GmbH:

1. Right of information: the right to find out which data has been processed and in what way.
2. Right of amendment: the right to require that incorrect personal data which is not up to date should be amended.
3. Right of deletion: the right to have personal data deleted.  
4. Right of restriction of processing: the right to restrict an instance of the processing of data.
5. Right for transferability of data: the right for personal data to be transferred directly from one system to another (in machine-readable form)
6. Right of objection: under the provisions of Article 21, GDPR, participants hold the right of objection to data processing at any time.
7. Right of complaint: participants may file complaints with the supervisory body applicable to Georg Neumann GmbH. The corresponding contact details are as follows:
